With China's economic development, the momentum of China's automobile sale in 2009 is more than 16 million, on the top of the world. On the one hand, the rapid increase of motor vehicles lead to a large number of personal injury; on the other hand, China's personal injury relief system for the automobile accident victim are still unable to meet the needs of the situation that the rapid increase of accidental damages. Relief fund mechanism for road traffic accidents put in the practice after the law enactment in the four years, but the local mechanisms start-up and the implementation need time. It is also difficult that the relief fund mechanism for the relief of victims plays its role because of lack of money.On the basis of the study on the theory of the risk liability, this essay introduces to the personal injury compensation for the automobile accident victims in the major developed countries and analyses the contents of tort liability, liability insurance and relief fund mechanism in China. Mandatory liability insurance has been implemented, greatly enhance the victim's multi-channel, multi-level, systematical relief support capacity, but motor vehicle relief fund system is just beginning, and now most of the provisions of the law stay on paper, mainly for lack of money. This paper attempts to explore the expanding source of relief funds to promote the rapid development of systematical relief for the automobile accident victims, and suggest the future prospects of our personal injury compensation system.
