A Research On The Constitution Of Business Briberies And Law Regulation

As a form of briberies, business bribery is an economic phenomenon which comes into being and gradually evolves with the economic development. It can be found in each country all over the world and various measures are taken to forbid it. By analysing the reasons it forms and its essences, this article elaborates on its destructive effects on economic orders and its negative social influences. The article also distinguishes business bribery from the normal marketing measures taken in business activities by studying the elements of business bribery behaviours. In addition, the thesis probes into the connections among business bribery, restricted competitions and behaviours like abusing superior statuses; it sums up the characteristics and different forms of business bribery behaviours. According to our national legislations and the law enforcing practices of fobidding business bribery behaviours as well as advanced legal experience in foreign countries, the article discusses the problems on how to regulate business bribery, how to protect a fair and ordered market and a healthy, harmonious society from the perspectives of improving legislations against unfair competitions, of transforming market economy system, of reinforcing law enforcement against business bribery.
