Discussion On The Substantive Law Basis Of Necessary Joint Action

Our existing legal framework provides the necessary common litigation system, but the legislation there is imperfect in some sense .The focus of this paper is not to carry out the necessary reconstruction of the common legal system, but based on our current law, the necessary basis for common action for the type of entity Construction。Author hoped that through simple language on the need for common action the procedural law of the system relies on the basis of substantive law to sort out, the substantive law and procedural law will closely integrate the construction of the system。During the proceedings, the judge could figure out the case of relevant facts one-time identification without conflict when all the parties attend the lawsuit together, which could make the judge figure out the truth or almost close to the truth as the result of the fact。In order to play this system it would have the effect, so that the economy and respect for the parties to litigation the right to appeal the perfect combination.。...
