Drunken driving behavior frequently occurs in our society which has a long history of wine culture, and the news of drunken driving tragedy is frequently reported in the newspapers .The tragedy is startling and shocking. Drunken driving behavior has caused great harm to the victims and their families. It is more important that drunken driving behavior constitute a great threat to travel security for people and the safety of public community. The Criminal Law has two kinds of crimes in the sub-chapter. They are the crime of a traffic accident and the crime of endangering public safety in a dangerous way. But which kind of crime drunken driving belongs to? Is the perpetrator's subjective state intentional or negligent? This article will discuss the questions in specific cases.With the continuous development of modern society, the number of cars is on the rise, and driving becomes one of the means of transport. It brings convenience to people's lives, but also leads to a number of risks. Modern automotive society is the risk society in certain points of view. How should we understand the risk behaviors? How should we correctly understand the risk of driving behavior and drunken driving behavior? The questions will be discussed in this article.The structure of the article is: the first and second chapters summarize the conduct of drunken driving, and the controversy will be discussed combined with the specific cases of drunken driving charges; the theory of the danger allocation of drunken driving will be discussed in the third chapter. The objective attribution theory will be introduced. The risk of drunken driving behavior will be analyzed with the theory. The fourth chapter will mainly focus on perpetrator accountability of drunken driving. We will discuss the kinds of perpetrator accountability and some other things which should be attentive.
