Discussion On The Withdraw From The Complicity

The theory on the withdraw from the complicity appeared in order to compensate for the insufficiency of the theory on the crime suspension and solve the problem about the responsibility of complicity of some co-perpetrator to suspend their own criminal acts, but failed to effectively stop crime. That is so it has its own independent value and function. Although the Japanese scholars have conducted a heated debate, but the theory is still very immature .Especially in China, the theory is still in the stage of introducing foreign theories. This paper aimed at Chinese current criminal law, and studied the theory on the withdraw from the complicity from two aspects, such as the time and the standard condition. At last , the paper pointed out that the discussion just related with the theory on the withdraw from the complicity from the only aspect related to micro-systemic issues, the macro-systemic issues and the improvement of the theory still need further in-depth study and discussion.
