An Analysis Of The Rural Migrant Workers' On-Job Injury Insurance System

The newly revised Labor Contract Law of the People's Republic of China (the following are referred to as "labor contract law ") issued on January 1st,2008 states clearly that workers share equal rights of employment, rest and vacation, remuneration, social insurance and so on, of which social insurance is considered as the necessary provision, which is the primary right of labor. The social insurance law of the People's Republic of China (draft) also stipulates the endowment insurance, unemployment insurance, medical insurance, injury insurance, birth insurance and social insurance system, of which the system of inductrial injury insurance is the important part of social security system; It is in the world the most widely-used one, which safeguard the rights and interests of every worker in production, and promote enterprises's safe manufacuture, maintain social stability.With the reform and the urbanization process of urbanization and industrialization, a large number of surplus rural migrant workers flow into the city, who are in the period of social transformation in China, and they play an important role in promoting economic growth. However, due to the workers themselves and social factors, most rural migrant workers engage in fields like construction, mining, manufacturing with highly risks and high frequency of occupational disease. And in recent years, the inductrial injury accident and occupational disease occurs mostly in rural migrant workers. But our original industrial injury insurance system only covered the citizens of the town enterprises and institutions and was exclusive to the rural migrant workers. It is not only related to the basic rights of workers, but also related to realization of social stability and harmonious socialist society goal; so how to maintain the lawful rights and interests of the migrant workers, to establish and perfect the system of inductrial injury insurance for migrant workers is not only a key issue, but also the essential theory to resolve a social, economic and political issues.Based on the existed data and the theoretical basis, the industrial injury insurance is analyzed. Firstly, the author introduces the origin of migrant workers, and then analyzed theory of the rural migrant workers' injury situation home and abroad on basis of Chinese rural migrant workers'problems existing in the system of inductrial injury insurance. Finally, with the analysis of other countries's industrial injury insurance system, the author intends to propose the suggestion on inductrial injury insurance system of rural migrant workers and its relative specific measures, such as the household registration system reform, coverage expansion, etc.
