Research On Domestic Adverse Drug Reaction Monitoring And Relief System

Drugs are two-edged swords, curing diseases and bringing potential risks at the same time. Adverse drug reaction is a typical example.so how to balance the benefits between medical enterprises,consumers and the whole society,to provide timely relief for victims and separate risks and share pressures of medical enterprises as well and to promote the whole development of the medical industry is a question worthing researching and discussing.Five parts are divided as follows:Part 1: The first part is about the relevant law problems of adverse drug reaction, inclunding adverse drug reaction defined by law and the analysis of law responsibility on adverse drug reaction. It describes the definition, characters and reasons of adverse drug reaction ,building basis of further studying on supervision and relief systems of adverse drug reaction. We bring out fault principle opted suitably and introduce the principle of risks and responsibilities to help the imputation of adverse drug reaction.It's the precondition of studying how to relief.Part 2:Concluding the situation on supervision and relief of adverse drug reaction in our country today and proposing a series problems like imperfect supervision system, ineffective coordination between supervising departments and blank relief system.Part 3:Describing and evaluating relatively more mature relief system of adverse drug reaction in Taiwan and foreign countries, inducting different relief pattern and analyzing the advantages and disadvantages of each pattern.Part 4:Some suggestions on how to perfect the supervision and relief systems of adverse drug reaction in our country.First combining with the existing system of our country,we bring out some supervision measures on improving drug supervision system of law, innovating working system of drug supervision and so on. Then we propose to build a relief system which takes responsibility insurance system primarily and relief funds auxiliarily and to set identification procedures of adverse drug reaction strictly and establish special identification agencies on the basis of both foreign advanced experience and our country's situation.Part 5:In the last part,the writer is drawing a conclusion,putting forward the new ideals and the defection of the article.With the rapid development of medical industry and more new medicines appearing on the matket, the adverse action resulted by drug itself and its damages begin to show serious consuquenses.As to solving the problem, law educational world has different opinions and studying directions.Some focus on supervision before new drug appearing on the market,others focus on perfecting relief system.However both opinions have sidedness. Only to take a two-pronged approach and combine supervision (especially safety supervision after new medicines appearing on the market) and relief together effectively can we create a harmonious atmosphere of using medicines at ease and truly protect comsumers'legal rights.
