Private property means the individual have right to invest,dominate and earning. Every stage of human society is accompanied by the development of property rights.Property rights develop from emphasis on the rights of individuals to the social nature. And with the research of legal protection of private property rights in depth, our awareness of the Western private property rights protection system which improving the economic prosperity of their enormous contribution is increasing.The legal system of private property is undoubtedly the basic legal system of human society, related to the rise and fall of civilization. Protection of private property, can regulat power of the Government, improving our country's basic economic system,and the same time it is meaningful to rule the country,getting to a well-off society and becoming a perfect citizens' personality.Constitutional amendment of protect private property rights have passed six years. in these six years,we both saw confirmation of property right in China played an active role in the economy,also saw property right proection system is still not well enough,but to correct the imperfect system again and again have landmark sence. As the samples of private property protection are exposure by media,people touch a never,the awareness of people's right protection is growing that require a comprehensive system to be established.Therefore, private property rights protection system should be improved as soon as possible, the system should be based on the Constitution as commander in chief, comprehensively carding all cases of property rights, legal system, so that the constitutional principle of protection of private property, can be implemented and chieved in reality.
