| With the rapid development of Internet and related industries, dispute of virtual property is constantly increasing. The legal problem of virtual property has aroused the whole society's attention. The recognition of legal attribute and the protection of virtual property has became a new subject in law research. Based on other research results, this paper focuses on the analyse of attribute of object of real right of virtual property. The protection of virtual property and other issues are also explored in this paper. The paper is divided into three parts:The first part describes the property attribute of virtual property. According to the description and criticism toward relevant perspectives of virtual property, this part mainly discusses the property attribute of virtual property. The particularity of virtual property is illustrated and the significance of virtual property is in the range of property is also explained in this part.The second part is the core of the whole paper. In this section, the real right attribute of the virtual property is mainly analyzed. Beginning with the object of real right, the author draw a conclusion that virtual property have real right attribute by thorough analysis and research of object and object of real right. The third part is civil law protection of virtual property. Based on the clarifying legal attribute of virtual property, the virtual property should be protected by the civil law. The author expounds it from both tort law and real right law, and gives some suggestions to specific onus.In summary, virtual property have property attribute. It can be used as object of real right. The correct orientation of virtual property's real right is helpful to bringing virtual property into the civil law protection. Although the system should be improved, for example:burden of proof, onus and so on, the author gives some suggestions on these aspects. The author hopes that these suggestions will benefit the protection of virtual property.
