Under the circumstances of peace and development, which was gained through wars and conflicts, economic globalization has gradually promoted the status and influence of economic relationship among different countries. The United States being the only superpower in the world, its legal institutions, which are of great value in research and reference, have gained world concern like its science and technology. With the continuous expansion of the US-China Trade relationship, our government and scholars have showed more concern on US-China Trade policy. Moreover, we can't ignore the decisive function of the United States Congress in making and implementing the trade policy. The United States Congress plays multi-roles in foreign trade policy institution, like an actor, a supervisor and a limiter, however, its power endowed by constitution have not arisen enough concerns yet, and so it is with the limitation endowed by constitution. The United States Congress, organ of supreme power, is endowed with the supreme power and status, which makes it have an important effect on international trade especially the sino-American economic relation in the United States's foreign trade policy institution. In addition, the United States Congress foreign trade system has experienced two stages, one of which is that the United States Congress solely enjoys foreign trade power, and the other is that the United States Congress should share the power with the president, whose origin and development are based on the theory of sovereign people, the seperation of powers and checks and balances, limited government and constitutional government and so on. The powers of the United States Congress consist of legislative power, fiscal power, supervisory power, approval power, and right of confer. When implementing foreign trade powers, the United States Congress is mainly limited by the American Constitution, executive branch, judicial review and precedents, and force of the community. PNTR bill fully embodies these contents and features.
