The Research Of Trade And Human Rights In Multilateral Trading System

Nowadays, world multilateral trading system has been developing and expanding. At the same time human rights protection is also forming one strands of upsurge, which drives development and improvement of human rights protection system. Under the circumstance of economic globalization, trade and human rights, two kinds of legal system, have caused more and more many conflicts and interactivity, arousing worldwide concerns. So the relationship of trade and human rights becomes a heated argument.First, this article has analyzed the trade and the human rights production historical and the development, which embodies natural conflicts at this stage; After World War II, the relationship of trade and the human rights mainly displays conflicts between the multilateral trading system and the international human rights protection system under economic globalization's background. Then the paper analyzes the conflicts of most representative human rights and WTO rules, such as right to development, environmental rights, the right to health and labor's rights and WTO rules. Comes again, this article elaborates the concrete method of coordinated the conflict. Looking from the conflict traditional theory of coordinated free trade and the human rights protection, the historical development, the pursue goal and the content, the relationship had the coordinated possibility. Moreover the coordinated practice of European Union region organization had taken good exemples. The ways of coordinating conflicts of free trade and human rights protection are as follows, some treaties explanation, using the WTO conflict organization, making related treaty and realizing the international law constitution. Finally, the paper is about trade and human rights protection in China. Our country has already made related laws and rules concerning the human rights protection, but it needs improved. When it comes to human rights protection, main problem we meet in the foreign trade is between the environment and the labors problem. It is our duty to improve related laws and rules, and actively contribute ourselves to international legislation. We should make use of the WTO dispute settlement mechanism to coordinate the conflicts.
