The natural monopoly industries just as telecommunications,electric power,railway transportation,postal service etc, are closely related with People's daily life.The characteristics of natural monopoly is that,they have fixed system and enormous sunk.These characteristics made natural monopoly free in the anti-monopoly law.But lack of legal regulation makes the natural monopoly industries appear lots of abusing dominant market position behaviors.These behaviors harm the public interests so much.For natural monopoly,it is reasonable monopoly or not,and whether it is regulated by anti-monopoly law,these problems is always the key and difficult matters in academic research.With the have been issued and implemented,how can the natural monopoly industries in our country been regulated by laws is really a hot topic.This text attempt to clarify the problems of natural monopoly industries in our country,learn from the western developed countries through comparative analysis method,and then clear the necessity of legal regulation of natural monopoly industries in our country.This essay also want to explore a path to regulate the natural monopoly industries of our country by laws.The full text is divided into five sections.The First Chapter is the theoretical analysis about legal regulation of natural monopoly industry.In this chapter,the concept and characteristics of natural monopoly is explained.Andthen,based on the theoretical analysis,we demonstrate the necessity about legal regulation of natural monopoly industry.This chapter is the theoretical basis of all the text.The Second Chapter analyses the restructuring experience and legal regulation of natural monopoly industry in our country.This chapter analyse the special of the natural monopoly industry in our country,and think that the problems in natural monopoply industry are caused by various factors,for example,there isn't a clear line between the functions of the government and enterprises.And then,this chapter introduce the government regulation reform of the natural monopoly industry.These analysis are the solid facts of the legal regulation of natural monopoly industry.The third chapter is an inspection among the regulatory reform and the practice of legal regulation of natural monopoly industry in other developed countries.America,England and Japan have advanced systems and practical experiences on the legal regulation of natural monopoly industry.Since the 1970s,the three countries held a regulatory reform on the natural monopoly industry.On the process of reform they take note of the function of the law.The regulatory reform and the practice of legal regulation of natural monopoly industry in other developed countries provide some valuable experiences for the legal regulation of natural monopoly industry in our country.The fourth chapter is the improvement approaches of the legal regulation of natural monopoly industry in our country.This chapter advocate that,if we want to improve the legal regulation of natural monopoly industry in our country,firstly,we must make a clear line between the functions of the government and enterprises,and separate the natural monopoly operation and the nonnatural monopoly operation.For the natural monopoly operation and the nonnatural monopoly operation,we must adopt different measures.This chapter is the innovative part of this paper.On the end of this chapter,we take a proposal about how to set up the regulatory agency of the legal regulation of natural monopoly industry in our country.The fifth chapter is the concluding part of this paper. The development of natural monopoly industry in our country need the help of law.We should improve the legal regulation to promote the development of the natural monopoly industry.
