A Research On Mass Incidents Triggered By Expropriating Land In Rural Areas

The financial crisis erupted from the US in 2009 attacks the entity economy gradually and the impact on China's economy continues to spread. Land disputes become prominent and hot issues today. This research is to prevent big conflicts aroused by small conflicts, to prevent the superposition and intensification of various types of conflicts, and to prevent general problems transformed from specific problems, political issues from economic issues, and overall issues from partial issues, thus maintaining the stability and realizing the scientific development. The purpose of this paper is to explore the current manifestation, the causes and the countermeasures of the mass incidents triggered by expropriating land.This thesis consists of five parts.The first part is an introduction, focusing on the research purpose, research significance, research status, research methods, and research structure, etc. The first part is the academic foundation of the whole thesis and enables us to have a macroscopic understanding of the topic.The second part is the analysis of the current status of the mass incidents triggered by expropriating land in rural areas. In general, the current status is showed as 1. the quantity of appeals to the authorities increases, and the problems reflected are concentrated; 2. people present their appeals to higher and higher authorities, and bypass the immediate leadership; 3. the opposing mood enhances, and the destructiveness of the incidents increases; 4. personal interest orientation is obvious in the mass incidents. In specific, the current status is showed as 1. A Large-scale collection of people appeal to the authorities, parade, and protest, without obeying the regulations; 2. people are gathered to surround and assault the party and government organizations, the Judicial organizations and the other important institutions; 3. people are gathered to block up the key position of public transport and traffic lines, and disrupt the order of public transport; 4. people are gathered to obstruct and impede the building of national and provincial key projects construction; 5. people are gathered to besiege and seize the state public servants.The third part explores the causes of the mass incidents triggered by expropriating land in rural areas. Immediate causes are: 1. government's administrative actions are not standard; 2. local governments ratify and occupy land illegally; 3. rural collective economic organizations default, retains, misappropriates, diverts compensation funds for expropriating land; 4. A small number of government officials and head of the rural collective economic organizations violate the interests of farmers by collusion, abuse of power and deception, etc. Basic causes are: 1. social transformation brings differentiation of the interests; 2. the system of laws and regulations of expropriating land is not perfect, which is short of democratic popular participation and effective supervision mechanism and punishes illegal acts of occupying land over-lightly; 3. the distribution of land income is irrational, not transparent and lack of consideration of landless farmers'interests; 4. The right of expropriating land is abused in the name of"public interests"; 5. the democratization and legalization management of grass-roots is not perfect, and the influence and representativeness of grass-roots organizations is weakened and even controlled by evil forces.The forth part discusses the countermeasures of the mass incidents triggered by expropriating land in rural areas. There are seven countermeasures: 1. to design the system of laws and regulations to protect the farmers'legal rights; 2. to standardize the behavior of expropriating land by governments to protect the farmers'legal rights; 3. to protect the farmers'legal rights for compensation placement and judicial relief; 4. to intensify efforts to crack down on illegal land use to protect the farmers'legal rights; 5. to strictly define the scope of"public interests"and limit the use and scope of expropriating land in rural areas; 6. to strengthen the construction of grass-roots organizations and democratically elect the leader of grass-roots organizations to represent the farmers'interests; 7. to properly handle the cases of appeals to the authorities triggered by expropriating land in rural areas to maintaining the stability.The fifth part is the conclusion.
