As the different concept, level and ways of intellectual property protection, United States and China continue to generate trade disputes that that caused by IPR. United States-China intellectual property litigation case, that brings the greatest impact between the two countries in recent years. It makes States pay more attention to the criminal protection of intellectual property. We won in this appeal, but it dose not mean no problem in China criminal protection system of intellectual property.In recent years, every countries put intellectual property into national economic development strategy, advanced intellectual property system can promote national economic development and technological progress, China is no exception. We should continue to increase efforts to combat intellectual property infringement, improve the penal protection of intellectual property. Before joining the TRIPS Agreement, China's IPR criminal protection system should be entirely in accordance with our national conditions. But as a party to TRIPS Agreement, China should comply with TRIPS Agreement provisions on the criminal protection of intellectual property. From the perspective of this case, Criminal Protection of Intellectual Property in China has reached the level of the requirements of TRIPS Agreement on member states. As we try our best to build the world's advanced level of protection of our intellectual property is concerned, we can not Satisfy with a litigation victory, But should see gaps between our country and the world which is in the advanced level.U. S. criminal protection of intellectual property is much higher than the requirements of TRIPS Agreement, which has much to learn for us. we need to seize this opportunity to reflect the problems, which our criminal protection of intellectual property system has, and to compare our country's situation with U. S on the system of criminal intellectual property rights, and to summarize our problems, and to proposed some suggestions.
