"Property Law" come into force on October 1,2007. Among the section of the Usufructuary right, the article 123 says," The exploration rights, mining rights, water rights and the aquaculture fishing rights using waters which acquired according to the law are protected by law", make sure that the aquaculture fishing rights use the Unsufructuary right provision. The development of fisheries resources property rights system has just started. The article is writing in the context of this background, studying the System of Property Rights in the field of Fisheries resources.In this paper, we use the method of value analysis, empirical analysis and logical deduction. The value of civil law is to meet the needs or interests of the civil subject (people). The value of the property law is the protection of property rights. Value analysis method is our main line of thoughts to clarify the property theory. In addition, the idea of empirical analysis provides a practical lively elements to the construction of our theory. The idea of logical deduction, is a touchstone which used to test the rationality of our theory and the firmness of knowledge framework.The Article is divided into four chapters. The system of property of Fishery resources rights, the overview in fisheries resources of ownership, the design of fishery resources usufruct system, the exploration of fishery resources interests system. The main content start around the ownership system, the usufructuary right system and the security interest system of Fishery resources, which core is the usufructuary right system. Here, we analysis the usufruct property of fishing rights, give the process details of fishing rights from the setting, change to eliminate. We also made the initial idea of paid circulation system of Fishing rights, in order to make useful insights on the property rights system of fisheries resources in China.
