Lost income is the actual lost revenues that the obligators should pay to the victims suffering injuries that do not have the ability to work from this period (loss of working time) to recovery. Lost income is one of the compensation items for personal injuries, the extent to which victims can obtain judicial relief directly depends on how much the amount of compensation is, while the amount of compensation is calculated according to certain standards of the results, using different criteria will have different impacts on the parties. However,the legislatives on personal injury compensation system are uneven, the existing laws and regulations in this aspect are conflict, the scope of compensation and the compensation standards are not uniform, these conflicts have seriously affected the judicial practice work and justice. This paper describes the lost income with special claims to personal injury system in China history, current situation of some analysis and presents the problems in our personal injury compensation system to make a few solutions.This paper is started by a specific case material:Part One:First introduce the basic merits of the case, including the basic facts of the case, the focus of several controversies in the trial process, and the outcome of the case.Part Two:Focus on analysis of several different academic perspectives on the case and the reasons, and describe the present case analysis for the views of the author.Part Three:Point out the root causes of disagreement, and for personal injury compensation system in our country,the author puts forward several legislative proposals.
