Health isn't paid attention until the advocating of The Charter of Organization of United Nations and the "WHO Constitution", and the women's human rights becomes an international issue as a universal human rights in the integral part of deprivation. Based on the special physiological function and women's social position of the disadvantaged groups of health, the appeal obviously can't stay in equal level, there is no doubt that its rights as human beings, and ignored the birth and discrimination in the edge, women must be more protected.In modern times, the realization of women's fight for the right to health is actually a self-conscious awakening and redemption, therefore, health can not be simply defined as the physiological well, and should be given a higher content of the psychological perfect. Indeed, China's policies and regulations of the women's rights protection covers a wide range, but "both the right to health in a positive affirmation of nature-based, and passive negative Constitutional Right", are still not demonstrated in the Constitution, then, the dimension of concern is limited, the development of the space is relatively narrow, therefore, the paper quoted the economic, social and cultural rights to the international convention on health, aims to highlight definitions and national health to women. Although women's rights protection in our country has made remarkable achievements, but the rigid provisions of the law in its operability often have a weak maneuverability. Human rights is always looking for a balance between law and morality, the lacking of humane care to the rigid rules, it must be contrary to the "harmony" of the social ideal apparently. Increasing demands of human rights in the concept of gender equality develop a new road for the health rights for women, it is another milestone of women's human rights movement. This paper, combined with some survey data are discussed, and combining with China's specific historical cultural background, and women's health legislation sources.right attribute, etc, analyzes women's health status in China's development, the existing problems, and proposed suggestions, in order to protect this right which will be improved and developed as soon as possible.
