On The Rationality Of Criminalizing The Sex Bribery

As the typical case of the non-material bribery, the sex bribery exists extremely widely, which directly infringes honesty of national staff. The exchange between the power and the sex greatly undermines the morale of society, which gives the image of state organs adverse effects. Its attraction and perniciousness have even surpassed the material bribery. The social perniciousness is enormous. But, there is no law about the sex bribery in China's Criminal law or in the amendment to the Criminal Law or in the specific criminal law. The lack of legal norms causes this behavior to be in flood day by day. The criminal offenders are rampant day by day. The sex bribery has brought up innumerable amative officers, which arouses huge popular indignation. Therefore, many experts have appealed that the sex bribery will be punished by the criminal law as soon as possible. This article thinks that the punishment of the sex bribery by criminal law has the rationality. In this article, the sex bribery is mentioned from the crime of bribery firstly. Then the article lists several reasons about criminalizing the sex bribery, and carries on the evaluation to some main opposition viewpoint. At last, the article proposes some legislative proposals about punishment of the sex bribery by the criminal law.
