Study On The Legality Of Anti-dumping For Exchange Rate

As an unfair means of competition in international trade , exchange rate dumping has been universally condemned by the international community. But the problem about legality of anti-dumping measures for exchange rate in the current system has not been extensively discussed and reached a consensus in academia.In view of this, as a starting point, this paper analizes the allegations of RMB exchange rate dumping from United States'three bills in 2007. On the basis of this, the authour will make deeper study on the legality of anti-dumping for exchange rate.At first, combination of multiple exchange rate provisions of WTO system and existing RMB exchange rate system, the paper analizes the relationship between multiple exchange rate and exchange rate anti-dumping. Subsequently, with reference to WTO provisions and case report, the paper elaborates whether the"fair comparison"requirement in Anti-dumping Agreement can prove the legitimacy of exchange rate anti-dumping, and then discuss the validity of"corrected value"with a case from WTO. In the following chapter, resort to demonstration on implement elements of anti-dumping measures, the paper further clarifies the interrelation between exchange rate anti-dumping and WTO rules.Based on above research, the authour believe that exchange rate anti-dumping doesn't exist legal and factual appliaction basis. Finally, with a view to safeguarding legitimate rights of our country , this paper will make a preliminary discussion about our country's authorized counter-mesures in face of exchange rate anti-dumping.
