Research On The Integration Of Investigation Of Official Offense

It is the statutory functions of the procuratorial organs in China to investigate the official offence. The integration mechanism of investigation crimes committed as an institutional arrangement of the current job-related crimes prosecutors investigating ,is the prosecution in the current constitutional system, the institutional framework for investigating crimes committed ,under the laws of the profound grasp and mechanism innovation. The concept of detection integration of the official offence, is the pattern of job-related crimes investigation, the above-level public ministry as "leading", the following stage's procuratorate as the fulcrum ,the investigation command center as the organization form, mentioning office, assigning, and supervising the joint office as the main means of handling cases, unified managing the significant cases within the jurisdiction of the clues, Unified organizationing and commanding the investigation of the major and complicated cases, unified dispatchingthe power of detection and surveillance equipment, the prosecution investigation that is in close collaboration with ,in order to detect the optimum allocation of resources ,to improve the overall effectiveness of the investigation,In the theory , job-related crimes that are more investigations to explore, were proposed the establishment of an integrated detection mechanisms. In recent years, the prosecution in Regions established the investigation command center, that is the organizational form of integration mechanisms of the job-related crimes investigation , according to the relevant provisions of the Supreme People's Procuratorate of《Major cases on the establishment of job-related crimes investigation command center program (pilot)》in 2000 and《People's Procuratorate of job-related crimes on the investigation of major cases Command Center Interim Regulations》in 2002.The prosecution in regions have formulated the relevant rules and regulations combining local conditions ,providing a guarantee of the normal development of the integration. Currently investigation of the status quo of domestic job-related crimes, is still in a scattered, loose, non-standard state ,so far, and does not become a job-related crimes investigation Integration Mechanism of effective self-contained. So the establishment of job-related crimes investigation has very important significance in theorists and practitioners.The article is divided into four parts in addition to Introduction and Conclusion:The first part is an overview of official offence and the investigation of the official offence. It has mainly defined meaning for the official offence and the investigation of the official offence, and analysised the characteristics of both. Through the analysis of these issues, we can come forwards for investigation of job-related crimes with specific proposals, to investigate job-related crimes better.The second part introduces the basic theory of integration of job-related crimes investigation. I do an in-depth exposition about the job-related crimes investigation of the meaning of integration firstly, and analyze the need for China to establish such a mechanism. The conclusions indicate that China has environment and conditions for establishing mechanisms for detection of integrated mechanism of Job-related crimes .The third part describes the current situation of China's job-related crimes and problems of it. Old detection system has been unable to meet the needs of job-related crimes investigation, according to china's emerging trends in job-related crimes. We must establish integration mechanisms for criminal investigations that is suited to China's national conditions, by learning from the good practices of some foreign countries.The forth part analysis and discussions how to build integration mechanisms for job-related crimes investigation in China. Job-related crimes investigation is a systematic project, that has complete in several ways, about leadership system, institution-building, command mechanism, coordination mechanisms and staff development, to enhance the ability of the investigation of prosecution.
