Legal Analysis On US-China Safeguard Case Of Tires

The United States raised the case of product-specific safeguard measures investigation, which contains the value of up to 17 billion dollars in April 2009. This is first case the United States against Chinese products by the Obama administration, thus caused a great impact in the international arena.This paper starts from the United States legal system, analyzes the U.S. safeguard measures procedures, as well as the circumstances surrounding the case of special safeguard tire. Then author analysis WTO-related documents and the special safeguard measures in China comparatively. Then points that U.S. safeguard measures in China's tire was neither consistent with its international commitments, nor consistent with the relevant international documents. Author boldly simple forecasts the results of the case if the WTO dispute settlement mechanism deals with it. Then give some policy and legal improvements paths on China's safeguard measures on the negative impact.In the light of the importance of this case to China's foreign trade, the author's theoretical exploration and processing of the results of feasibility analysis is both objective and pioneering. The analysis of special safeguard measures on China's on the pros and cons, and make recommendations to improve the future path for China's foreign trade legislation may have some reference.
