Research On The Litigation Masters In The Period Of The Yuan Dynasty

This paper system research on litigation masters though processing of classical documents and present scholars'study results. Litigation masters'birth, development and declination, its structure in different historical periods, and functions in judicial practice are new subjects in Chinese legal history. The Yuan dynasty is a special feudal dynasty between Song and Qing dynasty, for nomadic people—Mongolia as the ruler and its natural tradition, the national operation of Yuan dynasty is difference from the center dynasty. Under the principle of "worship of ancestors and appropriate adaptations", the traditional culture of center plain is injected new institutional factors. The attitudes to litigation master in Yuan dynasty are difference from the other dynasties too. While carries on which to the litigation activity endures governs, it also gives the litigation activity space suitably, and bring the activity of litigation into the litigation masters by its'regulation. The Yuan Dynasty legal system history is a difficult question in Chinese legal history research, Its reason is various. Litigation masters in Yuan Dynasty research is a blank in this field. And it is also the innovation in this article. The author analyze these questions such as the reason for exist, structure and origin, functions of litigation masters in judicial practice and existence status of litigation masters under the special historical background objectively by looking up relative articles and materials.
