The Study On Mao Zedong's Thought Of Reform Of Prisoners

The criminal rehabilitation problem appeared after the social class in human society. In the private ownership of the exploiting class society, the rehabilitation of crimimals was a method of suppressing the resistance of the working class by the ruling class for the sake of protecting their own interest. From the establishment of the Chinese Soviet Republic to the foundation of the People's Republic of China, the Communist Party has always attached great importance to the issue of rehabilitating criminals, and regarded it as an important part of the Chinese revolution. After the founding of the People's Republic of China, the Chinese Communists led by Mao Zedong completely destroyed the old institutions of state violence, while creating brand-new criminal rehabilitation agencies by the people's sovereignty. At the same time, the Chinese communists conscientiously summed up the successful experience of the criminal rehabilitation during the Chinese Soviet Republic Period, Anti-Japanese Period and the Liberation War Period, inherited and developed the criminal rehabilitation thought of Marxism, combined the new situations and new problems that the People's Republic of China faced after its foundation, deeply thought about and explored the cimimal rehabilitation problems, which helped to form a complete system, content-rich crimimal rehabilitation thoughts and furtherly enriched the Marxist criminal rehabilitation theory, forming a series of criminal rehabilitation ideas with Chinese characteristics.Mao's ideas on rehabilitating criminals considered the Marxist materialism as the world view and methodology of the understandings of the criminal rehabilitation, the dialectics of Marxism as an important ideological weapon, the rehabilitation of criminals to new persons as the underlying objectives, which walked out a criminal rehabilitation road with Chinese characteristics, successfully achieved the arduous tasks of rehabilitating the war criminals, maintaining social stability, promoting economic development and defending socialist regime.The theoretical sources, practical basis, main contents, basic features and practical significance of the Mao's criminal rehabilitation ideas are targetedly analyzed and discussed in this paper. Mao's ideas of rehabilitating ciminals has enriched and developed the Marxist theory of criminal rehabilitation, which laid firm theoretical foundation for the Communist Party to explore criminal rehabilitation theory with Chinese characteristics and made great contributions to the Marxism in China. At the same time, Mao's thought of criminal rehabilitation is an important part of Mao Zedong Thought, a class nature, science, innovation, practicality and other characteristics of the time. The author study Mao's thought of criminal rehabilitation as a separate topic with scientific attitude and documentary research. Through Mao's philosophical foundation---" Human beings can be rehabilitated", and through the discussion of the principles, methods and ways of Mao's thought of criminal rehabilitation, furtherly come up with a complete system of Mao's thought of criminal rehabilitation and demonstrate the practical significance that Mao's thought guiding the theoretical innovation and the work of criminal rehabilitation in the current time. The innovation of this paper can be seen from the followings:1.a more systematic discussion of Mao's thought of criminal rehabilitation; 2. further explored and determined the appropriate time of the ideology of Mao's criminal rehabilitation----the Chinese Soviet Republic Period.
