The "Labor Contract Law of PRC" has been bringing far-reaching effect on corporation management, and staff recruitment and dismissal of management is no exception. At present, the "Labor Contract Law of PRC" has been implemented more than two years, and many companies continuing to explore the methods of recruitment and dismissal fitting for their characteristics. However, because of historical issues, there are still many risks on recruitment and dismissal.This paper start from human resources management issues the legal environment of the " Labor Contract Law of PRC". I think human resources development and management also should be in accordance with law in the Legal Economy era. this paper based on the Human Management theory, Labor Management Relations theory and Corporate Social Responsibility theory, study on recruitment and dismissal management of tourism enterprises, and explores the methods which help the tourism develop recruitment and dismissal management , cost control, avoid risk, and build a harmonious and stable labor relations to achieve long-term development.. This study content as follow:This paper which study on staff recruitment and dismissal management in tourism enterprises, combining features of tourism enterprises and giving full consideration to the " Labor Contract Law of PRC", analyze the legal impact on employee and the management of recruitment and dismissal in tourism enterprise.Staff recruitment and dismissal is on the importance of the development of tourism enterprises. Based on the analysis of tourism company recruitment and dismissal management, this paper discovers there are still some issues.This paper argues that Tourism Company's successful employee recruitment and dismissal management in the environment of the " Labor Contract Law of PRC", can achieve through internal management and Outsourcing management. In-house employee recruitment and dismissal management can be summarized into two aspects, the first, improving the effectiveness of recruitment through the establishment of a sense of Human Management and Corporate Social Responsibility; the second, avoiding legal risk. Similarly, for the conditional tourism enterprises, outsourcing can also enhance the recruitment and dismissal of management employees.
