Along with Chinese market economy development, comparative advertising exists widely nowadays, as a kind of methods of transporting commercial information and competition. Besides boosting the economic development, making good use of comparative advertising will contribute to the development of science and technology. However, comparative advertising often do the harm to the opposite side, and misleads the consumer. Our correlative laws have the vague attitude on the legitimacy of the comparative advertising. Because legislation is relatively weak, it is difficult to practice effectively in legal disputes for using comparative advertising. Thus researching the legal regulation of comparative advertising is urgent and important. Currently, in the condition of Chinese economic development, to prohibit all comparative advertising can not adapt to the development of economy and society. Therefore, basing on clearing the concepts and serviceable range of comparative advertising, we should perfect the legal regulation of comparative advertising.
