| Nowadays, the people's mediation, as a non-litigation dispute resolution method has been a popularity of the time because of the diversity needs of the dispute resolution methods by the social subjects. And it has also been an important dispute resolution mechanism, which is parallel with the civil action. This is the requirement and the outcome of the development of the monocracy society, which also reflects and accelerates a spirit of times of dialogue, multiple value, and win-win situation.During the coming years, people's mediation mechanism has been improved continuously during the process of the exploring, and has been expanding to new mediation areas on the base of traditional three-level mediation net, such as the authorization from the civil suit, light damage suit, and public orders etc. We have also developed some new industrial mediation committees to deal with the issues such as medical disputes, property management disputes, labor disputes, and traffic accident suit. Thus, we have developed a big mediation pattern preliminary.But problems of the people's mediation mechanism especially the absence of the legislation always make it facing embarrassed situations, which stop the steps of its own development.Therefore, in order to build up the people's mediation mechanism, we should take the first step on the legislation. To defining its characteristic, improve its construction, expand its scope, and also specify the procedure, raise the status of the People's mediation agreement. Especially, the state should provide more supports and indemnities. Further more, we should find the direction through the way of mediator team construction also.The article shall begin with the construction and the operation of the people's mediation mechanism, in order to show how the mechanism makes effects on the work of holding the stability of the community. And what is more important is to find the key to the difficulties of the mechanism through the way of revealing its causes.
