"Siding-Top-Brand"is a vivid metaphor on faking, counterfeiting brand in the market. It refers to the socio-economic phenomenon that criminals using other's goodwill such as famous brands, unique number, packaging and decoration, to reap improper benefits. It's an unfair competition in Socialist market economy. It not only violates intellectual property right to bring damages caused to the goodwill and economic loss of established corporation, but also harm the interests of consumers and left the market remained chaotic situation.In recent years,"Siding-Top-Brand"has been intensified, and the affected brands go from domestic to international. The product covers from cloths to home appliances and electromechanical goods. Subject of offense various from individual to manufacturer and company. Due to it is huge in scale, covering lots of areas and means, it has become the main factor that health of economy of block up our country develops quickly. And it's hard to monitor enforcement powers because such behavior always hitting line balls, using seemingly legitimate acts to cover it's nature, and from the fact that currently we are lacking of well targeting law and rules for regulation. This article starts from definition and classifications of"Siding-Top-Brand"and some analysis have been made on the reasoning and the social harmfulness. Combining on writer's frontline law enforcement experience, discuss on the enforcement difficulties. Finally, advice is given from legislation, law enforcement and legal advocacy, elaboration.
