Protection The Application For Registration Of Trademark

The main contents of this paper is researching protection the trademark during the application for registration. Presently, China's relevant laws concerning the protection of the trademark during this time is default,theorists also less concerns about this issue. Application period is a necessary stage if someone want to have the registred trademark. Protecting the application trademark is extension the registred trademark. This article based on the special mark of this period explains the reasons protecting the application trademark. Based on analysis the domestic and international application trademark protection measures, the writer prsent some practicle proposals to improve the protection of the application trademark. The writer divide the application for registration trademark into the general well-known trademark and ordinary trademark. The writer presents legislative proposals for different objects. We can learn from well-known registered trademark dilution theory to expand the scope of protection during the application for registration trademark which is famous trademark , introduce the interim protection measures in the patent system, and expand the scope of the "Anti-Unfair Competition Law".These legislative proposals are practical which can better play the role of trademarks in the market and promote the healthy development of the trademark system.This paper have five chapters. In the first chapter ,the writer introduce the the basic contents of application for registration trademark.for example the concept of application for registration trademark, characteristics, and status. In order to better understand the application for registration trademark, the author compare application for registration trademark with registered trademark and unregistered trademark, respectively. Described the similarities and differences. The second chapter discusses the reasons protecting the application for registered trademark. Chapter three focuses on China's "Trademark Law"and "Anti-Unfair Competition Law" protection of the application for registration trademark and inadequacies. Chapter four analyzes other countries, international conventions and regional treaties on the protection of application for registered trademarks . In fifth chapter, on the basis of comparative analysis, the author prsent some legislative proposals to improve the protection of the application for registration trademark.
