A perfect legal system of Mobile Communications technology standards should be an organically integrated specification of laws and regulations, national policies, and industry self-regulations, the physical performance of which shows as the management system of technical standards, the scientific management system of intellectual property and comprehensive system of laws and regulations .To research the legal system of 3G technology standards fit for our country, this article starts under the premise of definition of 3G and technology standards.First ,this article studied the detailed analysis of the current legal system and technical standards, then it summed up the current legal system ,including "Standardization Law," "Patent Law", "anti-monopoly law "and other relevant laws and regulations to regulate the technical standards, but also explored the defect of them . Then this article fully examined the international background of the mobile communications market, then analyzed the development of information technology standards as well as the relevant legal system in the United States, Europe, Japan, Korea and other countries or regions, and summed up the experience that can be used for China. In the end, we can build a perfect legal system for 3G technology standards of China, which is an integrated standards system with the kernel of laws and regulations,guided by national policies , assisted by a complement of industry self-regulations .A perfect legal system of 3G technology standards will not only promote the prosperity of China's mobile communication business, but will also promote the cause of intellectual property to a new level.
