A Study On The Administrative Ombudsman System

The ombudsman system, which originated from Sweden, has been widely adopted in many countries in the world through continuous transformation since born. Nowadays, it's been a typical paradigm, which is independent from the administrative system to ensure government accountability and civil rights. It also provides a flexible, pragmatic and important complementary for the public complaints mechanism. The Ombudsman system provides a useful insight into external supervision and public complaints handling mechanism, considering its great success in welfarism states. This article begins with the current research by domestic and foreign scholars, figures out the history, organizational design and institutional arrangements of ombudsman, try to make an objective assessment of its value in the representative democracy and popular sovereignty approach. Moreover, it also proposed a basic feasibility analysis and pattern vision of creating China's ombudsman system. In the end, this article's made a certain degree of reflection on how to avoid duplication of functions among ombudsman, administrative supervision system.
