Study On The Special Procedures In Juvenile Criminal

The minors are future builders of society. But the juvenile delinquency is already the world's "three major public hazards" together with environment pollution and drug taking and drugtrafficking. The question must arouse special attention. Because of the specificity in body and mind, the ability of juvenile's controllment and recognizance, campared to adults ,is not so good. Most criminal behavior are caused by weak will or sudden impulse. Subjective hostility of them is not deep. It is very promising for them to receive education and reform oneself. In order to adequately protect the juvenile, Many countries in the world have established the basic principles of separating the juvenile criminal case from the adult criminal case. Through this method, juvenile can successfully integrate into society again.Aside from the first Chapter of Introduction and the seventh Chapter of the concluding section, the main content of thesis is divided into five chapters.The second chapter introduces the concept of minors as well as the concept of juvenile delinquency, characteristics, causes and so on. The third chapter describes the theoretical basis for juvenile criminal proceeding and studies its legal origin in Western countries. The fourth chapter introduces the procedural models of juvenile criminal proceeding and analyzed our current juvenile criminal proceedings,point out the gap form international standards. The fifth chapter is the guiding principles of juvenile criminal proceeding. These principles include those of protection of the legal rights of juvenile suspects and defendants, comprehensive investigation, separation from adult cases, and professional handling of cases. In discussing each principle, the concept, connotation and main embodiment in the proceeding are explored in details.The sixth chapter offers concrete proposals for juvenile criminal proceeding. I suggest on how to improve protection of juvenile rights in criminal procedure. It is divided into three parts: Investigation stage, the prosecution and trial stages.
