Study On The Creation Of Land Development Rights In China

Land is the basis for survival and development, is one of nature's most valuable resources. The natural scarcity of land requires us to make full use of every inch of land science. Land protection in China mainly is mandatory, ignored the mandate of the provisions of protection for land use and important role. China is a socialist country ruled by law, to implement the rule of law, and our current laws of the land rights of content is not rich enough, there are loopholes. Property rights system is a basic economic system, land development rights follows the development of the times, the creation of land development rights in China is a concrete expression of international standards. Development rights belong to the areas of economic law, the study of land development rights will help fill the gaps in our laws and improve our system of land rights, protect land resources and maintain the environment, promote social equity and accelerate land reform in rural areas, achieve sustainable development, promote the healthy development of human rights, solve land management problems and practical problems, build a socialist rule of law and a harmonious society. This article consists of three parts, the first is the introduction, the second part of a total of five chapters, the third part is the conclusion. The first chapter introduces the land in law, land use, land use classification and the statutory forms and development of the meaning, concept and characteristics of land development rights, laying the groundwork for the later study. Chapter II discusses the theory basis of land development rights from jurisprudence, ecology, law and economics, and sociology of law in four areas, and both macro and micro analysis the creation of land development rights in China is feasible.
