Research On The Copyright Crime

As technology progresses and human society advances, the idea that knowledge is power and wealth has gone deep into people's mind. In the era of knowledge economy, lawbreakers cast their covetous eyes on the copyright which contains great fortune. Pirated books and soft-wares are common in our lives. Copyright crime becomes the act of overflowing, which makes people suffer big economic losses and disturbs the market order. With the rapid spread of Internet, the means of crime are more multiple and the conditions of crime are more convenient. Accordingly, the social harmfulness is more serious. In recent years, China intensifies efforts to the criminal protection on copyright in order to crack down on crimes and protect people's rights.However, we should know that the step of criminal legislation on copyright in China is a bit late. There're still some problems to be resolved. In this article, I will analyze the constitutive elements of copyright crime and judicial determination in practice.
