The service industry is the focus of today's international industry, and tourism in the service sector plays an important role and tourism has great development potential in our country. Tourism has become an activity between people and people's lives closely. However, due to the imperfections of the existing laws and regulations, resulting in a large amount of tourism services in the dispute, the lack of contract for the tourism system and clear legal provisions are the reasons for disputes. So, this paper intending to the relevant issues with tourism contract starts to explore in order to let tourism industry grows up in the healthy way.This paper includes six parts in addition to introduction and conclusion.Part one:An overview of the tourism contract. Tourism contract is eligible to have a legal means of travel between business people and tourists to travel to achieve the purpose of visit, a clear relationship of mutual rights and obligations of the agreement. Although the contract is similar to travel agents contract, but its main specific enough to warrant the type, provide comprehensive services, to fulfill demanding period, groups such as the characteristics of the unique nature of a contract. It divides into package tour contracts and tour travel agency contracts, the contract package tour is the most common in today's society, the most widely applicable to surface travel contract.Part two:The legal relationship of the tourism contract. Tourism contract includes tourists, Tourism operators, business and tourism service providers.The object of the contract is tourist and tourism operator's activity, the main elements of Tourism law the tourists and tourism operators' rights and obligations of both sides.in the tourism Contracts,the tourists apart from the basic rights as consumers, but also have the right to substitute.Tourists'Obligations pay travel costs and play third-party delivery obligations and tourism operators'main right is to charge travel expenses and the primary obligation is to organize, inform, security, and in accordance with an agreement to help deal with the provision of tourism products Part three:Tourism contract's legal system. It focuses on the formation of contracts, the validity of the contract, the performance of the tourism contract, tourism contract changes, termination, transfer and lifting, etc.Part four:The protection of the tourism legal relationship.This part focuses on the issues of the protection of the tourism legal relationship.Here is more detailed discussion of the travel contract liability for breach of contract, travel safety disputes, the legal system to protect the interests of consumers and other related contentPart five:Compensation for moral damage against breach of tourism contract.
