Study Of The Administrative ADR (Alternative Dispute Resolution) In China

China is suffering the transformation of the society now. There are more and more social conflicts and disputes, which have affected our society's stabilization and development, so we have to look for some more effective dispute settlement mechanisms. Consider of the lawsuit's native shortage, people recognized gradually that it is not the exclusive approach and best choice for dispute settlements, there are more other resolutions and we call these as ADR, i.e. alternative dispute resolution. Here I choose administrative ADR, only one kind of ADR, as my research object. I hope this may contribute to build a harmonious society and improve our country's dispute settle mechanism.Here I believe administrative ADR has its own specialties and advantages, it may and should be an effective way for the administrative dispute settlement. For this, there are many good operations and experiences in USA, Britain, Japan and France, we may study from them. Now in China, administrative ADR includes administrative mediation, adjudication, letters and visits and reconsideration etc. They brought many positive affects for dispute settlements, yet still have some shortages and should have more improvements. At the same time, we may study form the western countries and adopt one new administrative ADR, i.e. administrative review mechanism.
