Legislative Analysis Of Sexual Offenses Against Young Girls

Crime of raping underage girls refers to a criminal act which often happens, and its nature is very vile and social impact is serious. It has been strongly concerned by criminal laws of the world and the attack target of our criminal practice. In our criminal theoretical field, there are many different perspectives on the subject of the crime of raping underage girls, the necessity of being an independent crime and the relationship between the crime of raping underage girls and the crime of whoring underage girls. Over the years, judicial authority has released some relevant judicial interpretation, but these interpretations can not end the dispute, however, it arouses new controversy to the judicial interpretations.This article try to research on the crime of raping underage girls through the content and context analysis of some relevant questions of crime of raping underage girls,1 the absorption of the content of criminal laws of the world which is well worth learning, the combination of our real situation and the persistence of the principle of protecting the special rights and the right balance of criminal suspects. The purpose of the article is to establish reasonable legislation system which can protect underage girls, maintain social situation and accommodate to social condition.Based on this purpose, the paper focuses on relevant judicial interpretations on the crime of raping underage girls, adopts normative analysis to analyse legal norms of raping underage girls, takes advantages of historical method to analyse history evolution of raping underage girls and necessity of independent crime of raping underage girls, it also uses comparative method to compare the crime of raping underage girls with the crime of whoring underage girls, then a studing method which links the theories and practices to research the crime of raping underage girls under different conditions. On the basis of analysis, the paper figures out the solutions to relevant problems in order to make a contribution to China's relevant criminal theories.
