Province-directly-Governing-County Reform On Constitution

As the market economic system gradually established in China, City-Governing-County system revealed more and more of drawbacks in the real operation. In 1992, Zhejiang Province pulled the prelude of Province-directly-Governing-County reform. So far, more than 10 provinces in China have started the Strong County Enlarging Power and the Reform of Province-directly-Governing-County in finance system. The Province-directly-Governing-County reform has become a hot issue in China's academic circles, and many scholars researched it from the finance, administration and management perspectives, but research from the legal perspective is less than that. Therefore, on the basis of the finance, administration and management related theory results; this article researched and discussed its necessity, feasibility, problems and perfect measures mainly from the view of the constitutional law.First of all, this article from the current situation of China's local government system, analyzed the basic situation in our practice and the role it played; And then this article examines a series of abuses of the local government system in reducing government management effectiveness, bondage County economic development and for seriously false urbanization aspects, which analyzed a series of necessity in Province-directly-Governing-County reform. After that, this article describes the Province-directly-Governing-County reform in the theory and practice, both in terms of feasibility. First of all, in theory, the Province-directly-Governing-County reform could be in line with our Constitution, help to promote local self-government capabilities, lower the government's administrative costs, improve governmental efficiency, promote the county's economic development, expansion of the economic region, realization of social justice and resolve the paradox of bureaucratic theory. Secondly, in practice, the Province-directly-Governing-County reform had a series of institutional environment, including political, economic, social, cultural and technological conditions, and possessed the support of national policies and local practices. Once again, this paper analyzed a range of issues of the Province-directly-Governing-County reform in the practice of running, including the amplitude in the management range, the lack of supervision in extending the County and game of the subject whose interests is damaged, officers'shunt and reposing, the lack of supporting policy measures as well as the judicial division of the problem and so on. Finally, in connection with the problems of the Province-directly-Governing-County reform, the article proposed the measures of further improvement.
