The 21th century is a period of laws while it is an era for a great dev- elopment of higher education. The society needs more and more talent w- ith the development of world economy and the growing competition of comprehensive strength between countries. It is education especially hig- her education that cultivates talents. The politics , economy and culture will stagnate if one country don't have good higher education . It is easy to imagine that how important the construction of higher education in our country.Laws can ensure the development of higher education. In the history of China , our management system of higher education has witness run- ning by experiences. But with the establishment of the socialist market economy system and the opening-up of our , this management system of higher education can't adopt to the development of higher education even bloke it. So we must establish perfect system to develop our higher education.The legislation of higher education is an important character of devel- oped countries. In these countries , they all appeal to the laws when they find that higher education is much related to the behalf of the whole coun- try, laws become the basic measure to ensure ,consolidate and urge high- er education .so ,learning the experience of developing education of fore- ign countries must study their experience of managing education by laws. It is an important task to establish constituent law system of higher educa- tion in our country.The reason that I select America as my subject is that the USA is the most developed country on the higher education in the world and the mo- st mature on the law system among the west countries. The development of its higher education depends on the power of laws. After the second world war , higher education can develop rapidly and steadily in America due to the ensuring of the legislation of higher education. Just because of the legislation of American higher education, it can lead a dominative pl- ace in the world today.The analysis of the legislation of higher education after the second world war ,the exploration of background, content, effect of significant law of, the summary of the main experience of legislation of American higher education ,we can find that the great development of American higher education has close relation with legislation of higher education. What experiences we can draw from the U.S. is : first, estab- lish a perfect system of higher educational law; Second, the government should strengthen the"running education by law", elevate the position of American higher education; Third , the flexibility of the content of law of higher education is the key point to keep the energy of law of higher edu- cation;Forth, the advanced of background of laws can make the legislatio- n of higher education to develop consistently; Last ,changing the concept and attaching important to the legislation of higher education can play a great role of construction and development of higher education. I think these can guide our higher education legislation. It is my aim of this paper.The methods of documentation and comparison are used in the study. The starting point of the study is the based on classifying and analyzing the correlation materials about the subject in and out of China.The successful legislation of American higher education is the result of the development of the American politics ,economic and culture ,it is adapt to the society of the USA, so ,we should innovate the experiences of American higher education legislation when we learn from America.
