In recent years, multiple and huge mob crime makes much harm to society theorists andjudicial attention. Although relatively complex provisions of the relevant legislation was notclear enough to bring theory and judicial practice, a lot of confusion, so that scholars disputecontinued, resulting in a different judicial practice approach chaos. Therefore it is necessaryfor the basic principles of mob crime serious, in-depth study to explore, to guide the judicialpractice of mob crime conviction and sentencing.Careful study of the writings of others on the basis of academic achievement, combinedwith the status quo of China’s legislative and judicial practice, selected several difficultproblems related to mob crime analysis and study, with a view of mob crime and judicialpractice research work benefit. This paper is divided into five parts:Part I: Analysis of crime mob connotation. Authors combed the country profiles on mobcrime legislation, on this basis, the analysis of the concept of crime mob differentperspectives to arrive at their point of view.Part II: mob crime and common crime.
