On The Perfection Of China 's Technical Investigation System From The Perspective Of Citizen' S Privacy Right Protection

The characteristics of the technical investigation is technical, concealment,mandatory. When the investigators investigate a crime with technical investigationmeasures, they will inevitably come into contact with a lot of privacy of theparties.The legal regulation of technical investigation measure in our country is stillnot perfect, so easy to violations of the legitimate privacy. So, how to improvetechnical investigation measures and protect the privacy of citizens, is the urgentproblem.I introduce the relationship between rights of privacy and the technicalinvestigation in the first chapter. First of all, I give an overview of the technicalinvestigation and rights of privacy.then, I analysis the reasons that technicalinvestigation affects the rights of privacy. In the second chapter, I give a summary oftechnical investigation of the status of legislation. And i make a brief analysis of theprogress and shortcomings.In the third chapter,I introduce the origin of thereasonable expectation of privacy. And i analysis the value and significance of theprotection to the rights of privacy. I introduce technical investigation system aboutUSA and German in the fourth chapter, and summarizes some common points aboutthe protection of the citizen right of privacy between USA and Germany.In the lastchapter,I give some suggestions about perfecting the system of technicalinvestigation measure.Firstly,I summarize some principles about improve thetechnical investigation.I introduce the solutions about the protection of the citizenright of privacy which is in the technical investigation measure.
