Legal Analysis On The Protection Of The Layout Of China 's Integrated Circuit Layout Under The TRIPS Agreement

Integrated circuits design, production and testing of the three most importantareas of the division. The IC layout design of integrated circuits as an important partof the production process, is indispensable. For the protection of layout designs ofintegrated circuits, a matter of survival and development of the integrated circuitindustry. Early stage of the integrated circuit was born, the world was already theimportance of the protection of layout designs of integrated circuits.This paper describes the history of the integrated circuit industry, the need forprotection of integrated circuit design, IC layout design features, as well as analysisof why the traditional intellectual property law is not able to provide effectiveprotection for its new specific legislation but need.Subsequently, the paper then describes the history and current status of the UnitedStates, Japan, Taiwan, China and the European Union on the legalfull protection oflayout designs of the integrated circuits. Create a background highlights theimportant role of the TRIPS Agreement and the legal protection of layout designs ofintegrated circuits played.Finally, the paper describes our country to join the World Trade Organization, tothe TRIPS Agreement is modeled by enacting the " Regulations on Protection ofIntegrated Circuits " in2001. This makes the country able to synchronize oninternational legislation, and makespromoting the development of the China’s ICindustry. The article also pointed out that " Protection Regulations," the use of scarcejudicial practice there are some problems reflect the content of the regulations.
