A Feasibility Study On The Text Of China 's Joining UPOV Convention In 1991

New varieties of plants with fine genetic characteristics are the premise of thedevelopment of agriculture and forestry. The breeding of new varieties always needslong time and great financial, but the use and reproduction of others are very easy.The International Union for the Protection of New Varieties of Plants (UPOV)established in France in1961，and at that time France and other four countriessubscribed the Protection of the International Convention of New Varieties of Plants.The UPOV Convention came into force in1968. With the development of agricultureand forestry, it has been revised for3times, and formed in two effective texts of1978and1991. More and more countries besides developing countries become members ofthe UPOV. The UPOV Convention has been the most comprehensive conventionabout new varieties of plants all over the world.Our country joint the UPOV in1999and subscribed the text of1978.With thedevelopment of our country’s economy, voice of requirements of China’s accession to1991text is never stop.My paper is divided into six parts.First part: IntroductionSecond part：Explaining what plant variety right is and The legislation of our countryThird part: investigating the formation and development of the UPOVConvention and point out the significance of it.Fourth part: Comparing the two effect texts of1978and1991though tableclearly.Fifth part:Combine the background and rationality of the changes and the currentsituation of our country discussing the feasibility of our country’s accession to1991text and come to the conclusion that our country should move to it step by step.Sixth part：Conclusion...
