A Study On The Criminal Protection Of Citizen 's Personal Information

Since Chinese reform and opening up, the network communication technologyhas been heavily promoted by the rapid development of our social economy, thuschanging the way of people’s social activities. But at the same time, the citizens’personal information was leaked and the risk also multiplied. In recent years, theselling and trafficking cases of the personal information occur frequently producing agray chain of illegal industry. As a most mandatory law, the criminal law plays a veryimportant role in the heart of the citizens’ personal information protection. Ourcountry "The seventh Criminal Law Amendment " for the first time to rules the sale,provide illegally, steal and other illegal ways, in order to highlight the people-orientedlegislation of Chinese criminal law idea and the aim of the harmonious societyconstruction, responding to the criminal protection demands of personal information.However, the criminal law has some defects in the protection of personal information,leading to problems in practice. Such as unstandard definition of personal information,unclear protection scope.This article is based on the social development and the actual situation ofcriminal law protection of personal information. We study carefully both at home andabroad criminal laws and regulations related to the protection of personal information.Contrasted by the criminal law, we aim to look for defects and give the suggestionsfor perfecting.This article is divided into three chapters. We analyze the problems of thelegislation with respect to the relevant clauses in the criminal law in the first chapter.The second chapter we summarize the related theories of personal information andprovide the theoretical basis for the perfection of criminal legislation about personalinformation. In the third chapter, we raise the corresponding legislative proposals andother suggestions with the defects put forward in the first chapter and theoreticalresults mentioned in the second chapter. We expect that it is useful for perfecting the criminal law of personal information.
