Under the influence of permissivism、diverse idea and unstable marriage,the coupledoes not trust each other as they used to be. In this case, loyalty agreement emerged at ahistoric moment. This contract means that if either person in marriage has theextramarital sex,he/she need to delivevy a large amount of money or some acts.Although this agreement emerged in early days,the debate on its legally binding hasnever stoped. Untill now,the idea to plunk for it valid take over central position. Well,aswe know,this kind of contract is different from the business agreement and we need toconsider its particularity. We can not affirm its legally binding simply. In my paper,Ichose an aspect——the loyalty agreement may cause some insurmountable problems inthe fields of morals——and combine its background、concept and the idea in judicatorypractice on this agreement to discuss the legal effect of this contract as detailed as I can.
