A Study On The Standardization Of Legal Terms

Legal language research in China has experienced three decades,the research them has grown,the areas involved expanding,obtaining a good result.But Legal terminology research is insufficient. Our country more and more scholars have realized the urgency of legal language standardization and has devoted to the study of legal language standardization.But no one put forward more scientific and systematic research method for the standardization of the legal term.Legal terminology research brought to the attention of some scholars in our country.On the basis of the research on the legal language standardization,legal terminology standardization research are put forward.Legal research on legal terminology standardization can combine law theory, linguistics theory, theory of terminology and knowledge of terminology standardization.And the research methods can be used literature analysis, discourse analysis and statistical analysis.The legal terminology has a lot of kinds classification.In accordance with the present conditions, legal terminology standardization can only start from narrow sense and the statutory legal terminology.Evaluate whether legal terminology has realized the standardization should have certain indicators,from the accuracy, professional, international and statutory.There are three different ways about inheritance of law terms, the old and new words with different meaning, the new words derived from the old words,the old and the new word are synonymous but different form.Inheriting law terms should follow two standards,the critical attitudes and keep pase with the times.Legal terminology borrowing mainly include translation of English legal terms and Japan these two ways.Borrowing must be adapted to local resources and respect the Chinese thinking and in line with international standards.The legal terminology innovation through reforming the old words, giving legal meaning for common words, and creating new words completely.Innovation have three standards,seizing the essence through the phenomena, aiming at economic、 succinct,forbidding fabricate.Legal terminology standardization must consider two points,one is the theoretical level,scientifically for naming a legal term,describing the definition, including legal interpretation.There are two principles when naming and choosing legal terminology,interpreting legal terms with the text interpretation and through the "supplementary provisions" or "other regulations" the two explanations.Another is the practical level,proposing to create a legal terminology database,from the source^annotation formatting and design retrieval of the legal terminology that entering into the database.
