Minors are a special class of groups in society.The high number of crimes face of the status of minors, juvenile delinquency also apparently become a serious social problem. It is related to the family’s well-being and social stability, and has been to the widespread public concern. Analysis shows that in our country, In recent years, the growth rate of juvenile crime is far greater than the growth rate of the same period in adults. With the improvement of social progress and the rule of law, countries are also increasing efforts to protect minors. Through the development of appropriate laws and regulations to achieve the interests of the protection of minors,"People’s Republic of China Criminal Law","People’s Republic of China Criminal Law Amendment (eight)","People’s Republic of China on Protection of Minors Act","People’s Republic of China Prevention of Juvenile Delinquency Act,""Supreme People’s Court on the trial of minors criminal law cases the application of a number of issues of interpretation, reeducation through labor regulations "and" Public Security Administration Punishments "have made the protection of minors corresponding provisions. However, the development of China’s legal system minors still in its infancy.Law is always fragmented and legislative system is imperfect, minors do not form a unified system of legal protection.The application of criminal penalties for minors remain flawed.So it needs to be constantly improved. So we should take our special juvenile delinquency into account, to adjust the penalties applicable to systems such groups. Therefore, we focused on issues related to juvenile delinquency penalties for deep study.The first part of the paper briefly introduces the concepts of juvenile delinquency and our status of minor crimes.Then conducted in-depth analysis of its causes. The second part focused on legislation related to juvenile delinquency to analyze domestic and summarized the problem of the legislative model. The third part is specifically discussed the issue of penalties applicable to juvenile delinquency, including principal penalty and a variety of additional punishment. In the last part,the author recommended mainly for social correction and other aspects of non-penalization juvenile delinquent as a supplement to the applicable penalty reforms,and put forward Recommendations for improvement.
