Research On Legal Supervision System Of Private Equity Fund In China

Private equity funds has developed vigorously in the past few years in China. For it is in the early stage, the assorted legal system of private equity funds has not been completed and the whole industry is in disorder. By analyzing the current situation and existing questions of the private equity funds and comparing advances control mode from other countries and regions, this paper is to build a harmonious and sound supervision of the private equity funds.The body of this paper includes five parts:The definition of the private equity funds and its development in China,The legal supervision of private equity funds in China and the value of the legal supervision, The legal supervision status of private equity funds and its existing questions in China, Analysis on legal supervision of private equity funds of foreign countries and their messages to us, Some regulatory proposals on supervision of private equity funds in China.Part1:The definition of the private equity funds and its development in China. This part first begins with the definition of the private equity funds and its classification.Then it describes the characteristics and organizational form of the private equity funds. Finally, this part introduces us the development process of the private equity funds in China.Part2:The legal supervision of private equity funds in China and the value of the legal supervision. First, this part begins with the concept of the legal supervision of private equity funds. The it introduces the3principles.Then, the paper analyzes the value of the legal supervision including economic value, law value and realistic value.Part3:The legal supervision status of private equity funds and its existing questions in China. This part introduces the legal supervision status of private equity funds by analyzing the provisions of laws and regulations. After the analysis above, the paper summarizes the existing questions.Part4:Analysis on legal supervision of private equity funds of foreign countries, Taiwan and their messages to us. This part studies the regulatory systems of the United States, Britain,Japan, and Taiwan. And then, the paper analyzes the beneficial messages to us.Part5:Some regulatory proposals on supervision of private equity funds in China. On the basis of the development and existing questions of the private equity funds and the foreign advances regulatory systems above, this part points out some proposals for improving the legal supervision system of private equity funds of China from the principles,systems and legislation of the legal supervision of private equity funds.
