A Study On The Problems And Countermeasures Of Legal Aid Mode In Yangzhou City

Legal aid, as a kind of free public service provided by government to the citizens with economic hardship or in special cases, has played an important role in protecting the equal legal status of the citizens, maintaining social stability and promoting social development. Since the1990’s, Chinese justice ministry formally proposed the establishment of legal aid system in China. Legal aid quickly unfolded throughout China. The legal aid institutions constantly summed up the experience through learning, reference, exploration, formed with local characteristics of the legal aid mode. But any mode can represent the temporary needs of practice. With the change of the social development, system reform, environmental changes, some typical models may no longer meet the requirements of the times. Meanwhile, any model is a methodology been summarized. Only in-depth to explore the connotation of the model, find the existing problems, analyze the causes and finally solve the problem, can we find the model’s true value, which can be used for reference to summarize the better mode of legal aidpeople undertaking legal aid case can provide better services, vulnerable groups can get better help, the Government can perform better public duties.Comprehensive measures have been taken in the process of the research and writing. Document study, collecting relevant document material both at home and abroad, is the base of theoretical research; Individual interview, exercising empirical investigation on the legal aid personnel and the legal case practitioners, provides the practical basis for the writing; Comparative analysis, experiencing contrastive analysis of the needs and characteristics of the legal case practitioners, draws a conclusion of the existing problems of the Yangzhou legal aid mode and gives constructive proposals. This paper, taking Yangzhou as an example, starts up from the perspective of the legal case practitioners and analyzes the problems encountered in the legal aid practicing work under the frame of present legal aid management mode and assistance mode. Some proposals and suggestions have been given on the basis of summing up of the experiences. Further more, some discussions have also been conducted on the future prospect of the legal aid mode in China.
