Research On The Civil Mediation System In The Construction Of Harmonious Society

Mediation, originated from the "harmony","bury the hatchet" Confucian ideas, is oneof the fine traditions of our judicial system with a very long history in our country. Ourcountry attaches great importance to the civil mediation and advocates it vigorously for along time; The mediation system has become one of the most important characteristics ofcivil litigation in China, known as the "Oriental experience" in the world. Civil mediationsystem has played an increasingly prominent role in promoting social harmony and stability,achieving social fairness and justice in the background of constructing harmonious societyof our country at present. Giving full play to the positive role of civil mediation system isparticularly important for the current opportunity. However, the social contradictionsbecome more and more complex with the deepening of economic, political, judicial systemreform in China. The current civil mediation system has exposed its limitations increasingly,which affect and restrict the construction of our harmonious society to some extent.Therefore, the present task in the people’s court trial is continuous improvement,innovation of civil mediation system and giving full play to its special functions in theconstruction of the harmonious society.It is divided into three parts from the perspective of building the harmonious society inthe paper. The harmonious social value concept and its concrete manifestation, thehistorical causes, development process, connotation and function of the civil mediationsystem are in the first part. The relationship of the civil mediation system and theharmonious society, the status and deficiencies of the civil mediation system are discussedmainly in the second part. Innovating the civil mediation system through the method ofestablishing diversification idea, improving the settlement system of civil mediation,determining the location of parties in the civil mediation system is discussed with theprocess of constructing the harmonious society in the third part. The aim of the paper is todiscuss the civil mediation system and the construction of the harmonious societydialectically, research the civil mediation system of positive role deeply in building theharmonious society through the systematic foundation for the construction of theharmonious society values and civil mediation system connotation and function, andanalysis the drawbacks of current civil mediation system rationally from the objectivereality, put forward several proposals from the respect of concept, system and operation mechanism, the angle of perfection and innovation of civil mediation system withefforts.
