Research On The System Of Fair Use Of Copyright In Network Environment

Copyright Law is the basic to protect the rights of copyright. A very important aspect of copyright law is the fair use which means to use others’ copyright works based on the legitimate purpose, without the copyright owner’s accession and payment according to the law. Fair use make much sence to keep the balance between the copyright owner and pubic rights. All countries acknowledge that the system. Since1990s, with popularization of computer, network and technology, internet has become a global media, and has been a great shock. Reserchers and countries have different pssitions and practices. The development of digital technology and network environments take the opportunities for copyright as well as an huge challenge for the traditional fair use. Creative works become more popular and dissemination of works become efficient, low cost and quality. The characteristics of propagartion and a large number of infringers of copyright make it more difficult for the copyright owner to maintain their own rights, and the balance between e copyright owner and the public interest balance has been broken. So it is necessary to research the fair ues under the network environment.In this paper, I studied the research results of other researchers, and study the history of the fair use system, and do some research on the nature and other basic issues of fair use. I elucidated the definition and characteristics of fair use system. Mentioned the value of the fair use system, and we also discuss the study of the theory, the system of the international convention, some developed countries and regions and our country. By some representative case of fair use, we analyzed the problem of fair use system under the network environment. In the end, I point out the idea of the construction of fair use of copyright in the internet environment. In order to make the system more perfect, we should create the legislation ideal model, use the technical measures reasonably, unite the statutory licensing system, advice the copyright compensation system and improve the system of collective administration of copyright and so on.
